In Il modello conversazionale, Poggi explores the question of whether the conversational model introduced by Grice adequately reconstructs our practices related to the interpretation of texts in the legal domain. And she does so by first analyzing Grice's model very thoroughly, refining it to explain what happens in the normative sphere, and then focusing on the particularities of the legal field and reflecting its impact. In this paper, I first present some aspects collected in the book and then make three minor critical remarks related to the type of thesis that Poggi maintains, the scope of her theses, and how Grice's model could be affected by externalist considerations, which only show the importance of her work in thinking about legal interpretation.
En Il modello conversazionale, Poggi aborda centralmente la cuestión de si el modelo conversacional de corte griceano reconstruye adecuadamente nuestras prácticas relativas a la interpretación de textos en el ámbito jurídico. Y lo hace analizando primero con gran profundidad el modelo de Grice, sofisticándolo con el propósito de dar cuenta de lo que ocurre en el ámbito normativo, para después centrarse en las particularidades del ámbito jurídico y rechazar su impacto. En esta contribución presento primero algunos aspectos recogidos en el libro, para plantear a continuación tres comentarios críticos menores, relativos al tipo de tesis que sostiene Poggi, al alcance de sus tesis y a cómo podría verse afectado el modelo de Grice por consideraciones externistas, que no hacen más que poner de manifiesto la incidencia del trabajo para la reflexión acerca de la interpretación jurídica.
