This article explores the extent to which the territorial water management project, a tool for territorial consultation, is useful for the agroecological transition. It compares the regulatory framework of this tool, the governmental directive of May 7, 2019, with feedback from fifteen territorial projects summarized in a CGEDD and CGAAER report published in May 2022. This soft law instrument, for which the legal framework remains fragile, creates possibilities to develop a dialogue between local stakeholders in order to achieve a fair use-related distribution of water, while respecting ecosystems. However, the transitional potential of this territorial tool is hampered by various obstacles, slowing down the transformation of agricultural water use.
Cette contribution explore la mesure dans laquelle le projet de territoire pour la gestion de l’eau, en tant qu’outil de concertation territoriale, constitue un instrument de la transition agroécologique. La recherche confronte son cadre réglementaire – l’instruction gouvernementale du 7 mai 2019 – aux retours d’expériences de quinze projets de territoire synthétisés dans un rapport du CGEDD et du CGAAER paru en mai 2022. Cet instrument de droit souple, dont le cadre juridique demeure fragile, permet de construire une concertation entre les acteurs du territoire afin d’aboutir à une répartition équitable de l’eau entre tous les usages, dans le respect des écosystèmes. Toutefois, le potentiel transitionnel de cet outil territorial se trouve freiné par divers blocages, ralentissant ainsi notamment les transformations de l’usage agricole de l’eau.
