Este artículo plantea una serie de redefiniciones de la teoría hervadiana sobre la justicia y el derecho; sin embargo, esto no supone modificaciones que afecten la esencia de este, sino que busca formular su terminología. Por ello, se exponen seis elementos de esta teoría, con el objeto de ser fieles al autor estudiado y, en esa medida, introducir ciertas variaciones o elementos adicionales que podrían suponer una pequeña modificación, o bien una ampliación, desarrollo o proyección de la teoría original de Javier Hervada. En términos metodológicos, se parte de una exposición de la doctrina del autor español en cada punto temático tratado, para en algún momento abordar esas posibles reformulaciones o variaciones terminológicas.
The article aims to propose a series of redefinitions of Hervadian theory of justice and law. It does not imply modifications that affect its essence, but rather ways of formulating or terminology. To this end, six elements of Hervadian theory of justice and law are presented, trying to be faithful to the author studied, and then introducing certain variations or additional elements that could represent a small modification, or an expansion, development or projection of Javier Hervada's original theory. Methodologically, it starts from an exposition of the doctrine of the Spanish author in each thematic point discussed, to at some point address those reformulations or terminological variations.
