The difficulties encountered by the Loyalty Islands province in drawing up its environmental code are a perfect illustration of the vicissitudes associated with power-sharing in New Caledonia. The exercise of its environmental protection powers is complicated by those assigned to the French government and the Congress of New Caledonia under the organic law governing the statute, as interpreted by the French Council of State. This legal framework makes it difficult to enact endogenous legislation tailored to local needs.
