Les obligations réelles environnementales garantissent, pour une période a maxima de 99 ans, l’affectation environnementale du bien grevé. Exclusive, la propriété devient alors inclusive. En effet, en principe les droits réels permettent à leurs titulaires de bénéficier des utilités de la chose sur laquelle ils portent. Or, les servitudes contractuelles environnementales garantissent un accès immatériel aux fonctions que le sol assure non au profit du seul bénéficiaire, mais au profit de la collectivité. L’inclusion est à la fois contractuelle et propriétaire. Il est ainsi possible de concilier droit de propriété et communs environnementaux sous réserve d’opérer une distinction entre un accès matériel exclusif au bien et un accès immatériel commun aux fonctions qu’assurent les sols.
Obligations réelles environnementales (conservation easements) guarantee, for a maximum period of ninety-nine years, the environmental assignment of an encumbered asset, rendering an exclusive property inclusive. These real rights in principle allow their holders to benefit from the utilities of the thing to which the rights relate. However, conservation easements guarantee immaterial access to soil functions, not for the benefit of the beneficiary alone, but for the benefit of the community. Inclusion is both contractual and proprietary. It is thus possible to reconcile property rights and environmental commons, provided that a distinction is made between exclusive material access to the property and common immaterial access to the functions provided by the soil.
