    Despite the reference to the “common heritage of human beings,” the 2004 Constituent did not intend to incorporate the notion of the “common(s)” into the Environmental Charter. The Constitutional Council called this into question by enshrining “environmental protection” as an OVC (objective of constitutional value). It has also been challenged by the recent proliferation of constitutional initiatives on the part of parliamentarians.

    Malgré la référence au « patrimoine commun des êtres humains », le Constituant de 2004 n’a pas entendu développer la notion des « commun(s) » dans la Charte de l’environnement. Le Conseil constitutionnel a remis en cause cette intention par la consécration de l’OVC de la « protection de l’environnement ». Elle l’est également par le foisonnement récent d’initiatives constitutionnelles de la part des parlementaires.
