    Over the last twenty years, three different orientations have characterized the Italian experience of the commons. The first is related to the revival of the rural commons, which, having survived more than two centuries of attempted dismantling, the Law no. 168 of 2017 finally recognized as legitimate and deserving of legal protection due to their historical importance, for which the legal historian Paolo Grossi was a fervent advocate. The second is linked to the group of activist legal theoreticians that includes Stefano Rodotà, Ugo Mattei, and Alberto Lucarelli, who have criticized private property as a source of injustice and developed bold draft legislation in an attempt to include the commons in the Civil Code. Finally, the third orientation involved using the principle of subsidiarity (Article 118.4 of the Italian Constitution) to multiply municipal regulations for managing urban commons. Despite their successes and common elements, these three different perspectives have not led to any real synergy and have always evolved disparately.

    Les expériences italiennes en matière de communs se sont déployées dans trois directions au cours des vingt dernières années. La première a visé à la renaissance des communs ruraux qui ont survécu à plus de deux siècles d’attaques et de tentatives de démantèlement. La loi n° 168 de 2017 a finalement reconnu la légitimité et l’indivisibilité de ces « domaines collectifs » à l’histoire séculaire, dont l’historien du droit Paolo Grossi a été un fervent apôtre. La deuxième a été prônée par la théorisation « militante » de juristes tels que Stefano Rodotà, Ugo Mattei et Alberto Lucarelli qui ont critiqué la propriété individuelle en tant que génératrice d’injustice et élaboré un projet audacieux pour essayer d’insérer les communs dans le Code Civil. La troisième a concrétisé le principe de subsidiarité (Constitution, article 118, 4ème alinéa) en multipliant les règlements municipaux pour la gestion des biens communs urbains. Ces trois différentes perspectives n’ont cependant jamais conduit à une véritable synergie et se sont presque toujours développées suivant des lignes non convergentes.
