El presente artículo (estudio de fondo) da cuenta de la situación de la niñez con discapacidad intelectual bajo custodia del Estado víctima de violencia institucional en centros de protección y el acceso a la justicia. Especialmente acerca de los ajustes de procedimientos que deben implementarse en los diversos procesos en que las víctimas participan. En específico, se mencionan aquellos que deben implementarse en una diligencia investigativa de un peritaje psicológico a través del Protocolo de Estambul. Este último es un instrumento internacional adoptado por la ONU para documentar e investigar posibles violaciones a los derechos humanos. Se consideran además elementos de interseccionalidad, al verse involucrados tres grupos de especial protección: ser niños, con discapacidad y bajo custodia del Estado.
This article (background study) reports on the situation of children with intellectual disabilities in state custody who are victims of institutional violence in protection cen- ters and their access to justice. It focuses particularly on the procedural adjustments that must be implemented during the various processes in which the victims participate. Specifically, it mentions those that must be implemented in an investigative procedure involving a psychological assessment through the Istanbul Protocol. The latter is an international instrument adopted by the UN to document and investigate possible human rights violations. Furthermore, elements of intersectionality are considered, as three groups requiring special protection are involved: children, persons with disabi- lities, and those in state custody.
