La nota prende spunto da una recente sentenza relativa a una vicenda in cui una ragazza era stata costretta, tramite plurime minacce, a realizzare e inviare un video che la riprendeva nel compimento di atti di autoerotismo. Il caso solleva la questione delle interazioni tra nuove tecnologie e violenza sessuale e impone di esaminare se, ai fini dell'integrazione di tale delitto, nelle ipotesi in cui la persona offesa sia costretta a compiere atti sessuali su di sé sia necessario che il reo sia fisicamente presente o comunque prenda visione (contestuale o differita) del compimento degli atti sessuali.
This paper is prompted by a recent ruling concerning a case in which a girl was coerced, through repeated threats, into recording and sending a video of herself performing acts of self-pleasure. This case raises the issue of the interplay between new technologies and sexual abuse, and calls for an assessment of whether, as a constitutive element of the offence, the perpetrator is required to be physically present during the performance of the sexual acts by the victim on herself, or at least be able to view them, either live or via recordings or pictures.
