La sentencia del Tribunal Constitucional de Chile, Rol N° 15.036-2023, rechazó un requerimiento de inaplicabilidad presentado por padres que se oponían a vacunar a sus hijos, basados en su adhesión a la medicina antroposófica. El Tribunal concluyó que la vacunación obligatoria, establecida en los artículos 32 y 33 del Código Sanitario, constituye una medida legislativa legítima, adecuada, necesaria y proporcional. Reafirmó que el interés superior del niño, prima sobre las creencias personales de los padres, señalando que la autonomía parental no es absoluta cuando se encuentra en juego la salud y la vida de los menores. Asimismo, descartó que la libertad de conciencia pueda operar como fundamento para eludir normativas sanitarias generales, especialmente aquellas orientadas a proteger a grupos vulnerables. En definitiva, el fallo ratifica que el Estado está habilitado para adoptar medidas generales de inmunización obligatoria, cuando estas se orientan a proteger derechos fundamentales y la salud pública de la población.
The judgment of the Constitutional Court of Chile, Rol N° 15.036-2023, rejected an inapplicability request filed by parents who were opposed to vaccinating their children, based on their adherence to anthroposophic medicine. The court concluded that compulsory vaccination, established in articles 32 and 33 of the Health Code, constitutes a legitimate, adequate, necessary and proportional legislative measure. It reaffirmed that the best interest of the child prevails over the personal beliefs of the parents, pointing out that parental autonomy is not absolute when the health and life of minors are at stake. It also ruled out that freedom of conscience can operate as a basis for circumventing general health regulations, especially those aimed at protecting particularly vulnerable groups. In short, the ruling ratifies that the State is authorized to adopt general measures of compulsory immunization when these are aimed at protecting fundamental rights and the public health of the population.
