El presente artículo busca examinar el concepto y desarrollo del acto cooperativo en el marco del Derecho Argentino. Luego de un repaso de aspectos principales de las cooperativas como entidades de la Economía Social y su naturaleza privada, reconocida en el Código Civil y Comercial, se analiza la definición del acto cooperativo y su regulación legal, subrayando su importancia en las “relaciones jurídicas cooperativas”. Se aborda el desplazamiento del “derecho común” en presencia de un acto cooperativo por las reglas y principios propios del derecho cooperativo. La jurisprudencia analizada ilustra la relevancia de reconocer la naturaleza asociativa de las relaciones entre socios y cooperativas. El artículo concluye destacando la necesidad de comprender el acto cooperativo como un elemento esencial en la interpretación jurídica de las relaciones cooperativas.
This article has the goal to examine the cooperative act's concept and developing within the framework of Argentinian Law. Following the review of the main aspects of cooperatives as entities of the Social Economy and their private nature, stated in the Civil and Commercial Code, this article analyze the definition of the cooperative act and its legal regulation, highlighting its importance in “cooperative legal liaisons.” ”. The shifting of “common law” because of the cooperative act and the rules and principles of cooperative law is addressed. The analysis of case laws illustrates the relevance of recognizing the associative nature of the relationships between members and cooperatives. The article concludes by highlighting the need to understand the cooperative act as an essential element in the legal interpretation of cooperative relationships.
