El presente artículo tiene como objetivo indagar en torno a la implementación del derecho a la consulta libre, previa e informada durante el proceso de reforma constitucional parcial de la provincia de Jujuy que se llevó a cabo durante septiembre del 2022 y junio de 2023. El análisis lo realizaremos teniendo en cuenta el desarrollo del contenido y alcance del derecho a la consulta libre, previa e informada de pueblos indígenas, que se encuentra en los instrumentos de derechos humanos, que tienen jerarquía constitucional, y que a la vez fue interpretado y desarrollado por diferentes órganos de los tratados, tanto en el sistema interamericano de derechos humanos (SIDH) como en el sistema universal de derechos humanos (SUDH).
Para esto identificamos y presentamos tres instancias de análisis dentro del proceso de reforma constitucional de Jujuy: una primera etapa durante la sanción de la ley de necesidad de reforma; la segunda etapa la elección de Convencionales Constituyentes y, la tercera etapa la discusión en comisiones, que coinciden con el proceso constitucional previsto en la Constitución de 1986. Recurrimos a información recolectada de los medios periodísticos provinciales como nacionales, la documentación presentada en procesos judiciales iniciados en el marco de la reforma y reportes de campo de observaciones realizadas durante el proceso.
The objective of this article is to investigate the implementation of the right to free, prior and informed consultation during the partial constitutional reform process of the province of Jujuy that took place during September 2022 and June 2023. We will carry out the analysis taking into account the development of the content and scope of the right to free, prior and informed consultation of indigenous peoples, which is found in human rights instruments, which have constitutional hierarchy, and which at the same time was interpreted and developed by different treaty bodies, both in the inter-American human rights system (SIDH) and in the universal human rights system (SUDH).
To this end, we identified three instances of analysis within the constitutional reform process of Jujuy: a first stage during the enactment of the law on the need for reform; the second stage, the election of Constituent Conventions, and the third stage, the discussion in commissions. We will resort to information collected from provincial and national journalistic media, documentation presented in judicial proceedings initiated within the framework of the reform, and field reports of observations made during this process.
