La controversia suscitada en la STS de 25 abril 2025 (RCUD 673/2023) se ciñe a determinar si el trabajador contratado por una ETT tiene a derecho a percibir la mejora voluntaria de IT contemplada en los convenios aplicables a las EU en donde prestaba trabajo en misión. Antes de esa STS, la jurisprudencia negaba ese derecho. La STS comentada cambia la doctrina pues el trabajador sí tiene derecho al complemento de IT.
The controversy raised by the Supreme Court ruling of April 25, 2025 (RCUD 673/2023) concerns whether a worker hired by a temporary employment agency is entitled to receive the voluntary temporary sick leave supplement provided for in the agreements applicable to the EU countries where they performed their work assignments. Before the Supreme Court ruling, case law denied this right. The aforementioned Supreme Court ruling changes the legal doctrine, as the worker is entitled to the temporary sick leave supplement.
