El retracto de colindantes, aunque históricamente concebido para favorecer la concentración de la propiedad rústica, se encuentra hoy en progresivo desuso. Ello obedece a la complejidad legal que afronta el retrayente frente al adquirente registral, así como a la carga económica derivada de las inversiones realizadas por este último. Además, la revalorización del bien complica el ejercicio efectivo del derecho. Todo ello ha debilitado su operatividad práctica en el ámbito del Derecho civil.
The he right of pre-emption of adjoining landowners, originally designed to promote the consolidation of rural property, is nowadays in progressive decline. This is due to the legal complexity faced by the pre-empting party against the registered purchaser, as well as the financial burden arising from the latter’s investments. In addition, the revaluation of the land complicates the effective exercise of the right. All these factors have weakened its practical relevance in civil law.
