La aprobación de la Ley 3/2024, de 13 de junio ha supuesto una reforma sustancial del Código del Derecho Foral de Aragón en materia de capacidad jurídica de las personas con discapacidad. Esta modificación responde a la necesidad de adecuar el Ordenamiento aragonés a los postulados de la Convención de Naciones Unidas sobre los derechos de las personas con discapacidad de 2006, adoptando un modelo que sustituye el esquema tradicional de incapacitación por un sistema muy flexible de apoyos, basado, ante todo, en el respeto a la autonomía y la voluntad de las personas con discapacidad, pero sin olvidar su dignidad, derechos e intereses.
Este trabajo se dedica, en concreto, a ofrecer una panorámica general de las concretas medidas de apoyo que lo integran, esto es, el mandato de apoyo, la guarda de hecho, la curatela y el defensor judicial.
The Law 3/2024, of 13 June, has implied a significant reform to the Code of Foral Law of Aragon regarding the legal capacity of persons with disabilities. This amendment responds to the need to adapt Aragonese law to the principles of the United Nations Convention on the Rights of Persons with Disabilities of 2006, adopting a model that replaces the traditional incapacitation scheme with a more flexible system of support. This new model prioritizes respect for the autonomy and will of persons with disabilities, while ensuring the protection of their dignity, rights and interests.
This paper is dedicated to examining of the specific measures that make up the new support system, in this order, the support mandate, de facto guardianship, curatorship and legal guardianship.
