Honour is a central value in press law which is protected mainly by measures regarding libel, insults and outrages, and by the right to respect for the presumption of innocence. Its rather vague legal definition not being a hindrance to its apprehension, the judge has developed the jurisprudence regarding the protection of honour around three criteria: a behaviour contrary to the law, to morality and to probity. The analysis of this notion demonstrates that it has evolved along with social transformations, conferring a remarkable adaptability to the 1881 law.
L’honneur est une valeur centrale en droit de la presse, protégée principalement par le délit de diffamation mais aussi par celui d’injure ou d’outrage, ainsi que par le droit au respect de la présomption d’innocence. Sa définition juridique restant imprécise sans être un obstacle à son appréhension, le juge a construit la jurisprudence relative à la protection de l’honneur en s’appuyant sur trois critères : comportement contraire à la loi, à la morale ou à la probité. L’analyse de cette notion démontre qu’elle a su évoluer avec les transformations sociales, conférant une remarquable adaptabilité à la loi de 1881.
