Para proteger a las mujeres y a los menores víctimas de violencia de género pueden adoptarse medidas de distinta naturaleza. Diversos instrumentos de DIPr resultan potencialmente aplicables para adoptar estas medidas en situaciones con elementos internacionales, así como para su reconocimiento transfronterizo. Para identificar el instrumento aplicable se requiere calificar cada una de las medidas atendiendo al sujeto objeto de protección y a su naturaleza. Los instrumentos aplicables para la adopción y el reconocimiento de las medidas de protección de la madre y del menor difieren y queda excluido un régimen uniforme.
Measures of various kinds may be adopted to protect women and minors who are victims of gender-based violence. Different Private International Law instruments may potentially apply to implement these measures in situations with international elements, as well as to their cross-border recognition. To determine the applicable instrument, each measure must be classified based on the person to be protected and the nature of the measure. Consequently, the instruments applicable to the adoption and recognition of protective measures for the mother and the child differ, and a uniform regime is therefore excluded.
