La historia de discriminación y violencia hacia el grupo étnico de los Rohingya, en Myanmar, no es ningún secreto. No son escasas las organizaciones que abogan por una pronta solución a lo que ocurre en este país asiático. En este escrito pretendemos traer a colación el estado de los procedimientos que se están llevando a cabo en distintas jurisdicciones internacionales para la rendición de cuentas en Myanmar. En concreto, examinaremos el estado de los procesos ante la Corte Internacional de Justicia, la Corte Penal Internacional, y la Corte Federal Argentina. Una vez examinados dichos procedimientos, procederemos a tener en consideración dos posibles alternativas adicionales: la instauración de un tribunal internacional ad hoc, y la instauración de un tribunal penal mixto. Destacaremos los obstáculos que tanto los procesos actuales como las alternativas futuras tienen para tener éxito en sus respectivas labores, siendo el objetivo de todas ellas la rendición de cuentas por los crímenes cometidos en Myanmar contra la población Rohingya, especialmente el crimen de genocidio
The history of discrimination and violence against the Rohingya ethnic group in Myanmar is no secret. There is no shortage of organisations calling for an early solution to what is happening in this Asian country. In this paper, we seek to bring to the fore the status of the proceedings underway in various international jurisdictions for accountability in Myanmar. Specifically, we will examine the status of proceedings before the International Court of Justice, the International Criminal Court, and the Argentine Federal Court. Once these proceedings have been examined, we will proceed to consider two additional possible alternatives: the establishment of an ad hoc international tribunal, and the establishment of a mixed criminal court. We will highlight the obstacles that both the current proceedings and future alternatives face in succeeding in their respective endeavours, the objective of all of them being accountability for the crimes committed in Myanmar against the Rohingya population, especially the crime of genocide.
