La paradoja de los derechos humanos implica que existimos y discutimos como abogados. Ello, con un sesgo favorecido por un sistema que enfatiza naturalmente en “los derechos” sin atender, o bien, entender el elemento “humano”. La tradición humanista tanto de la Constitución Política de los Estados Unidos Mexicanos, como del derecho internacional más que sugerir, ordena robustecer y acentuar el hecho de que el humano es el énfasis del sistema actual y, aún así, ¿realmente estamos avanzando de manera adecuada en la evolución de los sistemas de derechos humanos? En la consecución de nuestros fines ¿estamos transitando en el camino correcto? Se sugiere una escala de comprensión y análisis, así como una herramienta franca para entender el sistema de derechos humanos y su evolución, partiendo de la diferenciación entre dicotomía, dualidad y polaridad.
De esta manera, la polaridad se encuentra inmersa en todos los sistemas de vida y desarrollo natural, incluyendo en los humanos, se convierte en una manera objetiva de medición y análisis evolutivo de nuestro sistema actual. Ello resulta porque es ineludible analizar lo que tenemos hoy y sería inexcusable dejar de preguntarnos si estamos transitando en la dirección adecuada.
The paradox of human rights implies that we exist and argue as lawyers. This bias is favored by a system that naturally emphasizes “rights” without address-ing, or even understanding, the “human” element. The humanist tradition of both the Political Constitution of the United Mexican States and International Law, rather than merely suggesting, mandates strengthening and accentuating the fact that the human being is the focal point of the current system. And yet, are we truly advancing adequately in the evolution of human rights systems? In the pursuit of our goals, are we on the right path?A scale of understanding and analysis is suggested, along with a simple tool to understand the human rights system and its evolution, based on differentiating between dichotomy, duality, and polarity.Polarity is embedded in all systems of life and natural development, including humans, and becomes an objective means of measuring and analyzing the evolution of our current system. This is essential, as it is unavoidable to analyze what we have today, and it would be inexcusable not to ask ourselves if we are moving in the right direction. Moving where? Towards a near future that will challenge law, humanity, and possibly, or frankly, society.
La paradoxe des droits de l’homme implique que nous existons et débattons en tant qu’avocats. Cela, avec un biais favorisé par un système qui met naturellement l’accent sur les «droits» sans prêter attention ou même comprendre l´élément «humain». La tradition humaniste, tant de la Constitution politique des États-Unis Mexicains que du droit international, ordonne davantage qu’elle ne suggère de renforcer et d’accentuer le fait que l’humain est au cœur du système actuel et, pourtant, avançons-nous vraiment de manière adéquate dans l’évolution des systèmes de droits de l’homme? Dans la poursuite de nos objectifs, sommes-nous sur la bonne voie?Il est suggéré une échelle de compréhension et d’analyse, ainsi qu’un outil franc pour comprendre le système des droits de l’homme et son évolution, en partant de la différenciation entre dichotomie, dualité et polarité.De cette manière, la polarité se retrouve immergée dans tous les systèmes de vie et de développement naturel, y compris chez les êtres humains, et devient un moyen objectif de mesure et d’analyse évolutive de notre système actuel. Cela est nécessaire, car il est inéluctable d´çanalyser ce que nous avons aujourd›hui, et il serait inexcusable de ne pas nous demander si nous avançons dans la bonne direction. Vers où? Vers un avenir proche qui s›oppose au droit, à l›humain et, peut-être ou même probablement, à la société.
