En el presente trabajo se analiza la función notarial de control de legalidad en Chile a partir de su configuración como notario de tipo latino. Para ello, se exponen los principios que inspiran la función del notariado latino y la configuración de la función notarial en Chile. Tras ello, se examina la función notarial de control de legalidad y sus diferentes manifestaciones en el ordenamiento chileno, poniendo de relieve la ausencia de reconocimiento legal expreso con carácter general de esta función, lo que lleva a proponer argumentos a favor de incluir dicho reconocimiento en futuras reformas notariales.
The present work analyzes the notarial function of legality control in Chile from its configuration as a Latin-type notary. To this end, the principles that inspire the role of the Latin notary and the configuration of the notarial function in Chile are outlined. After that, the notarial function of legality control and its different manifestations in chilean legal system is examined, highlighting the absence of express legal recognition of this function in general terms, which leads to propose arguments in favour of including such recognition in future notarial reforms.
