    Este trabajo examina cómo un error en la declaración afecta la manifestación defectuosa de la voluntad y las diferentes alternativas que tiene el contratante que lo padece para proteger sus intereses a partir de las reglas del Código Civil. Luego de analizar el fenómeno e indagar en las diferentes alternativas que han ofrecido la doctrina y los tribunales, se propone la incardinación del supuesto en las reglas del error-vicio, habida cuenta de la necesidad de ponderar los distintos intereses jurídicamente relevantes que se ven involucrados.

    This paper examines how an error in declaration affects the defective manifestation of will and the various alternatives available to the contracting party suffering from it to protect their interests under the rules of the Civil Code. After analyzing the phenomenon and exploring the different solutions provided by legal doctrine and courts, the study proposes the categorization of the assumption within the rules of error as a vice, considering the need to weigh the various legally relevant interests involved.
