Se analizó el derecho humano a la familia como impulsor o propiciador de otros como el de la recreación y sano esparcimiento así como el interés superior del menor establecidos en tratados internacionales y en la carta magna, cuyo cumplimiento deben ser garantizados por el Estado, los cuales pueden ser violentados por la actividad del hombre como la construcción en zona federal de playas, particularmente en la Zona Federal Marítimo Terrestre, regulada por la Ley General de Bienes Nacionales y el Reglamento para el Uso y Aprovechamiento del Mar Territorial, Vías Navegables, Playas, Zona Federal Marítimo Terrestre y Terrenos Ganados al Mar. Mediante trabajo de campo con la realización de diversos estudios y la metodología adecuada por parte de la ciencia de la Ingeniería Civil con un levantamiento topobatrímetrico y fotogramétrico con su debido procesamiento de información, se demostró que en el municipio de Mazatlán Sinaloa, particularmente de playa Punta Camarón-Punta Sábalo de la zona costera, todas las construcciones del ramo hotelero, restaurantero o de residencia violan las leyes que delimitan la zona federal, algunas limitando el acceso y a su vez reduciendo la zona de playa, violentando los derechos humanos y fundamentales mencionados.

Through field work with the realization of various studies and the appropriate methodology by the science of Civil Engineering with a topobatrimetric and photogrammetric survey with due information processing, it was shown that in the municipality of Mazatlán, particularly Punta Camarón-Punta Sábalo beach in the coastal zone, all the constructions of the hotel, restaurant or residence branch violate the laws that delimit the federal zone, limiting access and its time reducing the beach area, violating the aforementioned human and fundamental rights.
