El presente texto trata sobre el derecho a un medio ambiente saludable y la vigencia de la prohibición del retroceso en los niveles de protección ambiental en el ámbito normativo internacional. A partir de ello, la investigación tiene como objetivo analizar, mediante un estudio normativo y doctrinario profundo, el derecho a un medio ambiente ecológicamente equilibrado en las esferas del derecho internacional y del derecho comunitario, con un análisis adicional de la prohibición del retroceso, incluyendo una investigación sobre su definición y naturaleza jurídica. En el aspecto metodológico, se adoptó predominantemente el método de investigación deductivo, aplicando técnicas de investigación bibliográfica y documental. Como resultado, se señala, a partir de una conjunción de varios instrumentos internacionales de soft law con tratados internacionales vigentes, la actual previsión del derecho a un medio ambiente saludable para las generaciones presentes y futuras como un derecho humano autónomo. Se concluye, también, que persiste una consolidación normativa de la prohibición del retroceso en los niveles de protección ambiental, entendida como un principio general de derecho ambiental
The present text addresses the right to a healthy environment and the validity of the prohibition of regression in the levels of environmental protection within the international normative framework. Based on this premise, the research aims to investigate, through an in-depth normative and doctrinal study, the right to an ecologically balanced environment in the spheres of international and community law, including an analysis of the prohibition of regression, with a further investigation into its definition and legal nature. Methodologically, the research predominantly adopts the deductive method, applying bibliographical and documentary research techniques. As a result, it is noted, through a combination of various soft law international instruments and existing international treaties, that the current recognition of the right to a healthy environment for present and future generations is established as an autonomous human right. It is also concluded that the prohibition of regression in the levels of environmental protection remains normatively consolidated, being understood as a general principle of environmental law
