A principios de este año quedó claro que el objetivo de limitar el calentamiento global a 1,5 °C, acordado en el Acuerdo de París, no se iba a cumplir en 2024. Las consecuencias del cambio climático ya son claramente perceptibles en muchas partes del mundo y sigue siendo urgente actuar. Por ello, es necesario explorar cómo la economía y la protección del clima pueden interactuar para lograr una transformación exitosa a largo plazo de la industria hacia la neutralidad climática. El instrumento de contratos de carbono por diferencia (CCfD), lanzado el año pasado por el Ministerio alemán de Economía y Protección del Clima, pretende iniciar la necesaria descarbonización de la industria, un enfoque que está desempeñando actualmente un papel pionero. Este artículo analiza la base jurídica de los CCfD en la legislación alemana y la sitúa en su contexto nacional y europeo. El objetivo del análisis del diseño sustantivo y procedimental es explicar el mecanismo subyacente y debatir las oportunidades y los retos del instrumento. Por último, se elaboran los requisitos previos para una aplicación con éxito, especialmente la condicionalidad firme, con el fin de debatir un posible efecto modelo
Earlier this year, it became clear that the goal of limiting global warming to 1.5°C, as agreed in the Paris Agreement, would be missed in 2024. The effects of climate change are already being felt in many parts of the world and the need for action remains acute. This raises the question of how the economy and climate change can be brought into a symbiosis to enable a successful long-term transformation of industry towards climate neutrality. The instrument of carbon contracts for difference (CCfD), launched last year by the German Federal Ministry of Economics and Climate Protection, is intended to initiate the necessary decarbonisation of industry —an approach that is currently taking a pioneering role. This paper analyses the legal basis for the CCfD in German law and places it in its national and European context. The aim of the analysis of the substantive and procedural design is to explain the underlying mechanism of action and to discuss the opportunities and challenges of the instrument. Finally, the prerequisites for a successful implementation —in particular the strong conditionality— will be worked out in order to discuss a possible model effect
