El trabajo se centra en comentar los artículos que fundamentan la responsabilidad de las personas jurídicas en México. En ese sentido, se habla sobre la importancia que tiene el cumplimiento normativo y la gestión de riesgos, como una forma de blindaje empresarial, para evitar que éstas, sean sancionadas penalmente. Finalmente, se advierte sobre la necesidad de hacer una adecuada individualización de la pena por parte del juzgador penal, para evitar subjetividades que se advierten en algunos parámetros de la ley.
The work focuses on commenting on the articles that support the responsibility of legal entities in Mexico. In that sense, we talk about the importance of regulatory compliance and risk management, as a form of business protection, to prevent them from being criminally sanctioned. Finally, it is warned about the need to adequately individualize the sentence by the criminal judge, to avoid subjectivities that are noted in some parameters of the law.
