La solidaridad es un elemento jurídico constitucional que dota de contenido a los derechos reconocidos en el marco de un Estado social. La actual crisis del Estado del bienestar ha supuesto una ruptura en la convivencia social dentro de las sociedades europeas, desproveyendo de valor jurídico y material al principio de solidaridad como elemento corrector de los Estados para lograr la cohesión social. Este artículo indaga en la plasmación jurídica de la solidaridad dentro del marco constitucional y su capacidad de desarrollo, enfocando la investigación al contexto español y sus posibilidades. De esta forma, se realizan tres fases de análisis: la introducción de la solidaridad como elemento filosófico dentro del campo del derecho público; el desarrollo del concepto como principio constitucional en el constitucionalismo social del siglo xx, y el estudio del principio de solidaridad en el contexto español con sus limitaciones y oportunidades de avance.
Solidarity is a constitutional legal element that gives content to the rights recognized in the framework of a social state. The current crisis of the welfare state has led to a rupture in social coexistence within European societies, depriving the principle of solidarity of its legal and material value as a corrective element of states in order to achieve social cohesion. This paper investigates the legal embodiment of solidarity within the constitutional framework and its capacity for development, focusing the research on the Spanish context and its possibilities. In this way, three phases of analysis are carried out: the introduction of solidarity as a philosophical element within the field of public law; the development of the concept as a constitu-tional principle in the social constitutionalism of the 20th century; the study of the principle of solidarity in the Spanish context with its limitations and opportunities for progress.
