Para llevar a cabo un despido disciplinario respecto de una persona trabajadora no afiliada a sindicato alguno, las exigencias formales eran muy sencillas limitándose a la carta de despido. No obstante, ya en la década de los 80 se discutió si, en base a lo previsto en el art. 7 Convenio núm. 158 OIT, era o no preceptivo, aunque nuestro ET no lo recogiera de forma expresa. Tras diversos debates y posturas enfrentadas, finalmente, se siguió la línea de entender que el art. 7 Convenio núm. 158 OIT no era aplicable. No obstante, recientemente, el TS se ha pronunciado en sentido contrario, exigiendo que se lleve a cabo dicha audiencia previa, so pena de calificar el despido como improcedente. En este trabajo se lleva a cabo un análisis del origen, fundamento y justificación de esta exigencia procedimental, así como del cambio de postura de nuestro alto intérprete.
To carry out a disciplinary dismissal with respect to a worker not affiliated with any union trade, the formal demands were very simple, limited to the dismissal letter. However, in the 1980s it was discussed whether, based on the provisions of art. 7 Convention no. 158 ILO, was mandatory or not, although our ET did not expressly include it. After various debates and opposing positions, finally, the line of understanding that art. 7 Convention no. 158 ILO was not applicable. However, recently, the TS has ruled in the opposite direction, demanding that said prior hearing be carried out, under penalty of classifying the dismissal as unfair. In this work, an analysis of the origin, foundation and justification of this procedural requirement is carried out, as well as the change in position of our senior interpreter.
