El trabajo aborda cuestiones relevantes relativas al régimen de responsabilidad que deriva del contrato de manipulación portuaria. Este contrato se ha regulado por primera vez en el ordenamiento jurídico español, en los arts. 329 a 338 de la Ley de Navegación Marítima. Esta normativa, sin embargo, no contiene una disciplina amplia y completa, puesto que algunos aspectos del contrato no se regulan o se hace de manera insuficiente.
El estudio trata, en particular, sobre la variedad de actividades que pueden realizar los operadores portuarios, la pluralidad y diversidad de intervinientes que participan en ese negocio auxiliar de la navegación, así como la posible integración del contrato de manipulación portuaria en el marco de un transporte multimodal. Todas estas circunstancias y hechos, que se analizan de forma extensa, poseen gran trascendencia jurídica y una importante repercusión en el régimen de responsabilidad que surge de la ejecución del mencionado contrato.
El examen efectuado pone de manifiesto que las operaciones de manipulación portuaria tienen una gran incidencia y alcance en el transporte marítimo y en el transporte en general, pero, al mismo tiempo, presentan una gran complejidad jurídica.
The paper addresses relevant issues relating to the liability regime arising from the portuary cargo handling contract. This contract has been regulated for the first time in the Spanish legal system, in articles 329 to 338 of the Maritime Navigation Act. These regulations, however, do not contain a broad and complete discipline, since some aspects of the contract are not regulated or are done so insufficiently.
The study deals, in particular, with the variety of activities that port operators can carry out, the plurality and diversity of participants who participate in this auxiliary navigation business, as well as the possible integration of the portuary cargo handling contract within the framework of multimodal transport.
All these circumstances and facts, which are analysed in detail, have great legal significance and a significant impact on the liability regime arising from the execution of the aforementioned contract. The examination carried out shows that portuary cargo handling operations have a great impact and scope on maritime transport and transport in general, but, at the same time, they present great legal complexity.
