Los principios garantistas sobre los que se articuló el Derecho penal liberal y humanitario emanado del pensamiento ilustrado quedaron completamente aniquilados en Europa a partir de la consolidación del Derecho penal autoritario, especialmente visible en Alemania tras la ocupación del poder por Hitler entre 1933 y 1945. El trabajo trata de poner de manifiesto que, durante aquellos años terribles, asistimos a una contaminación ideológica del Derecho penal subordinado al servicio de los planteamientos nacionalsocialistas, animados bajo los parámetros inspiradores de la creación, interpretación y aplicación de las normas referidos al reforzamiento de las estructuras del Estado, la incontestable voluntad del Führer, la inclinación a favor del espíritu y el sano sentimiento del pueblo y la supremacía y pureza de la raza aria. Quebraron por completo los pilares fundamentales sobre los que descansa cualquier Estado constitucional y democrático de Derecho y, con el apoyo dogmático incondicional de los académicos más prestigiosos, se legitimó un cuadro normativo aberrante en desprecio de la dignidad humana que repugna a la conciencia ética universal, provocando consecuencias hasta entonces inimaginables. Esta ignominiosa página de nuestra historia debería servir para reflexionar y adoptar medidas que eviten el riesgo de repetición.
The guaranteeing principles on which the liberal and humanitarian criminal law emanating from illustrated thought was articuled were completely annihilated in Europe after the consolidation of authoritarian criminal law, especially visible in Germany after the occupation of power by Hitler betweenn 1933 and 1945. The work tries to show that, during those terrible years, we are witnessing an ideological contamination of criminal law subordinated to the service of national socialist approaches, animated under the inspiring parameters of the creation, interpretation and application of the rules referring to the reinforcement of the structures of the State, the incontestable will of the Führer, the inclination in favor of the spirit and the healthy feeling of the people and the supremacy and purity of the aryan race. They completely broke the fundamental pillars on which any constitutional and democratic State of Law rests and, with the unconditional dogmatic support of the most prestigious academics, and aberrant normative framework was legitimized in contempt for human dignity that is repugnant to the universal ethical conscience, causint hitherto unimaginable consequences. This ignominious page of our history should serve to reflect and adopt measures that avoid the risk of repetition.
