    La investigación se centra en precisar el sentido de la expresión “u otra calamidad o desgracia” prevista en el artículo 10 número 12 del Código penal chileno. Para ello revisa analíticamente la historia y fundamentos de la disposición y se estudian los antecedentes criminológicos de estos tipos de delincuencia. Finaliza con una propuesta interpretativa.

    The investigation focuses on specifying the meaning of the terms “or other calamity or misfortune” stated on article 10 number 12 of the Chilean Penal Code, along with other aggravating circumstances applicable to this type of crime. With this aim, the history and foundations of the provision are critically examined and the criminological aspects of this type of crime are studied. An interpretation of the proposal is provided.
