El presente trabajo analiza los avances tecnológicos de la inteligencia artificial y su impacto sobre los derechos humanos desde una perspectiva filosófica y jurídica. Se ofrece una visión integral que combina el análisis normativo con la reflexión ética proporcionando herramientas para promover el uso responsable y equitativo de la inteligencia artificial. También se examinan los desafíos éticos y normativos asociados a esta tecnología, prestando especial atención a los neuroderechos. Por tanto, se plantea la necesidad de un marco regulador que garantice la protección de los derechos humanos en la era de la inteligencia artificial y las neurotecnologías asegurando que el desarrollo tecnológico se alinee con los principios de justicia, equidad y dignidad humana
This paper analyses the technological advances of artificial intelligence and their impact on human rights from a philosophical and legal perspective. It proffers a comprehensive perspective that integrates normative analysis with ethical contemplation, thus furnishing instruments to advocate for the conscientious and egalitarian utilisation of artificial intelligence. The analysis further delves into the ethical and normative challenges associated with this technology, with a particular focus on neuro-rights. The necessity for a regulatory framework that ensures the protection of human rights in the era of artificial intelligence and neurotechnologies is thus raised, with the aim of ensuring that technological development is aligned with the principles of justice, equity and human dignity.
