La Inteligencia Artificial trae consigo la promesa de la eficacia absoluta y la objetividad plena, superando las carencias de la capacidad humana. Su implantación está produciéndose de forma acelerada en múltiples espacios, incluyendo la actividad de las Administraciones Públicas. Sin embargo, se está haciendo de forma acrítica, sin la necesaria reflexión previa que ha de conducir a articular protocolos y exigencias de implementación para lograr el equilibrio entre eficacia y eficiencia de la actuación administrativa y mantenimiento de las garantías de legalidad y protección de los derechos e intereses de los ciudadanos, pero también a repensar las categorías que integran el actual Derecho Administrativo. En estas páginas se lleva a cabo un ejercicio de reflexión sobre dos de las principales categorías sobre las que se ha asentado la actividad administrativa formalizada del sector público –órgano y acto administrativo– para concluir que, aunque pueden mantenerse en esencia tal y como han sido concebidas, precisan de la articulación de algunas exigencias novedosas que permitan mantener un control efectivo sobre el funcionamiento y el producto final del sistema de Inteligencia Artificial por parte del titular del órgano al que se imputa la actividad administrativa algorítmica
Artificial Intelligence brings the promise of absolute efficiency and full objectivity, overcoming the shortcomings of human capacity. Its implementation is quickly taking place in many areas, including the activity of Public Administrations.
However, it is being done in an uncritical way, without the necessary prior reflection that must lead to articulate protocols and requirements to achieve a balance between effectiveness and efficiency of administrative action and maintenance of the guarantees of legality and protection of the rights and interests of citizens, but also to rethink the categories created by the current Administrative Law. In these pages an exercise of reflection is carried out on two of the main categories on which the formalized administrative activity of the public sector has been based –administrative body and administrative act– to conclude that, although they can be maintained in essence as they have been conceived, they require the articulation of some new requirements that allow an effective control of the algorithmic administrative activity and the final product of the Artificial Intelligence system.
