La función de Europol, en cuanto oficina de policía europea que coordina las distintas policías de los 27 Estados de la Unión Europea, es evidente que ha ido progresivamente acentuando el impacto de las investigaciones que se desarrollan en el marco de una unidad policial armonizada en los distintos procesos penales que se siguen en los Estados Miembros. En este artículo se trata de definir los impactos más significativos que han tenido las investigaciones de Europol en el proceso penal español con aquellos retos y desafíos que se van produciendo a nivel nacional y desde la implementación en otros Estados Miembros. Para ello, tomamos las referencias de la jurisprudencia más actualizada y que mayor impacto ha generado en los distintos ordenamientos de los Estados Miembros.
The role of Europol, as the European police office that coordinates the various police forces of the 27 European Union Member States, has clearly been progressively increasing the impact of investigations conducted within the framework of a harmonized police unit across the different criminal proceedings carried out in the Member States. This article aims to define the most significant impacts that Europol’s investigations have had on Spanish criminal procedure, along with the challenges and issues arising at a national level and from implementation in other Member States. To this end, the article draws upon the most recent and influential case law affecting the legal systems of the Member States.
