La imparcialidad del juez es la primera condición del sistema de justicia en una democracia constitucional. Idealmente, ella permite administrar los conflictos de inte- reses en el campo judicial y extiende su influencia como patrón de legitimidad del orden social y político. A partir del caso peruano, el presente trabajo explora su signi- ficado y también sus límites: se examinan los vínculos entre la imparcialidad, la liber- tad de expresión y la textura abierta que emerge del razonamiento judicial. Se busca develar el papel que la imparcialidad cumple frente a las influencias que actúan sobre el juez, las que provienen de la cultura institucional y forman parte del campo judicial.
The impartiality of the judge is the foremost condition of the justice system in a constitutional democracy. Ideally, it enables the administration of conflicts of inter- est within the judicial sphere and extends its influence as a standard of legitimacy for the social and political order. Drawing on the Peruvian case, this study explores its meaning as well as its limitations: it examines the relationships between impartiality, freedom of expression, and the open texture that emerges from judicial reasoning.
The objective is to uncover the role that impartiality plays in relation to the influenc- es acting upon the judge, which stem from institutional culture and are inherent to the judicial field.
