El ámbito de la responsabilidad hacia las generaciones futuras siempre ha tenido un lugar central en la historia reciente de nuestras sociedades, constituyendo un pacto vivo que cuenta con gran respaldo social y que, en consecuencia, se ve reflejado en medidas de aplicación en todos los órdenes jurídicos con el sustento básico de respeto al principio de solidaridad contemplado en la Constitución española. Dicho esto, es renovada la preocupación por el pacto intergeneracional que caracteriza el Sistema de Seguridad Social, por cuanto existen elementos intrasistema que justifican la necesidad de respuesta del Sistema al momento actual –caracterizado fundamentalmente por las llegadas de las generaciones del baby boom a la edad de acceso a la pensión de jubilación–, combinadas con alegorías intencionadas sobre la viabilidad del sistema, esto es, con el propósito de crear un relato falso que cale en la sociedad. Este trabajo pretende arrojar algo de luz respecto de este momento y la reacción legislativa para, entre otros problemas, afrontar la posible desafección hacia este principio por parte, sobre todo, de las generaciones de personas trabajadoras jóvenes.
The area of responsibility toward future generations has always held a central place in the recent history of our societies, constituting a living pact that enjoys broad social support and is consequently reflected in measures implemented in all legal systems, based on respect for the principle of solidarity enshrined in the Spanish Constitution. That said, there is renewed concern about the intergenerational pact that characterizes the Social Security System, given that there are intra-system elements that justify the System’s need to respond to the current situation –characterized primarily by the arrival of the baby boomer generation at retirement age– combined with intentional allegories about the system’s viability, that is, with the aim of creating a false narrative that permeates society. This work aims to shed some light on this moment and the legislative response to address, among other problems, the potential disaffection with this principle, especially among younger generations of workers.
