El Centenario de la muerte de Franz Kafka invita a recordar su genial obra literaria y su legado intelectual. En este trabajo se pretende poner de relieve la importancia que dentro de su obra revisten su concepción del Derecho, así como aquellas reflexiones kafkianas que suscitan mayor interés desde el punto de vista jurídico. Frente a las interpretaciones que aducen una hostilidad o un menosprecio de Kafka hacia el Derecho, en nuestro ensayo intentamos poner de relieve que su postura fue, más bien, la de una denuncia de las distintas manifestaciones de arbitrariedad legal y su consiguiente aspiración de un Derecho justo.
The centenary of Franz Kafka’s death invites us to reflect on his brilliant literary work and intellectual legacy. This paper seeks to highlight the significance of Kafka’s conception of the law within his body of work, as well as those Kafkaesque reflections that are of particular interest from a legal perspective. Contrary to interpretations suggesting hostility or disdain from Kafka toward the law, this essay aims to demonstrate that his stance was, rather, a denunciation of the various manifestations of legal arbitrariness and an aspiration for a just legal system.
