La hipótesis del presente trabajo es que la obra de Kafka permite dar cuenta de elementos que permitan delimitar una definición de justicia mínima. Para demostrar esto, proponemos una lectura de la parábola «Ante la ley» a partir de algunos elementos que relacionamos con Baruch Spinoza y su concepción de la justicia: (1) una atmósfera de miedo no debe predominar al interior del Estado, (2) los arcana imperii deben ser desterrados, y (3) que para que la república impere, instituciones como la ley deben funcionar correctamente. Estos serían los requisitos mínimos para hacer posible la existencia de la justicia, al menos en una definición austera que permita explicar las condiciones necesarias para que ésta pueda darse
The hypothesis of the present work is that Kafka’s work allows us to account for elements that allow us to delimit a definition of minimal justice. To demonstrate this, we propose a reading of the parable «Before the Law» based on some elements that we relate to Baruch Spinoza and his conception of justice: (1) an atmosphere of fear must not prevail within the State, (2) the arcana imperii must be banished, and (3) for the republic to prevail, institutions such as the law must function properly. These would be the minimum requirements to make the existence of justice possible, at least in an austere definition that allows us to explain the necessary conditions for it to exist.
