La apostasía es uno de los delitos contra la religión y la unidad de la Iglesia cuyos sus orígenes se remontan a los primeros años de la fe católica, bajo el Imperio Romano. Con su consolidación como religión del Imperio y su adopción por la mayoría de los reinos europeos desde la Alta Edad Media se fue conformando un cuerpo jurídico paralelo al derecho canónico que permitía a la jurisdicción civil castiga tal delito. A lo largo del presente estudio observaremos como fue su desarrollo normativo durante el reinado visigodo y, posteriormente, la corona de Castilla.
Apostasy is one of the crimes against religion and the unity of the Church whose origins date back to the early years of the Catholic faith, under the Roman Empire. With its consolidation as the religion of the Empire and its adoption by most of the European kingdoms since the High Middle Ages, a body of law was formed parallel to canon law that allowed the civil jurisdiction to punish such a crime. Throughout this study we will observe how its normative development was during the Visigothic reign and, later, the crown of Castile.
