La enunciación de una Teoría de la Justicia ha sido una labor abordada durante los últimos siglos desde perspectivas claramente diversas. Desde la defensa de la democracia deliberativa hasta la teoría de las capacidades humanas, se ha pretendido encontrar un camino hacia el Derecho justo. Las discrepancias entre estas posiciones han sido usadas por los defensores del relativismo para reafirmarse en la inexistencia de criterios objetivos de justicia. En el presente trabajo defenderemos los derechos humanos como punto de encuentro de las teorías de la justicia más relevantes y piedra angular del Derecho justo.
The enunciation of a Theory of Justice has been a task approached during the last centuries from clearly diverse perspectives. From the defence of deliberative democracy to the theory of human capabilities, there has been an attempt to find a path towards just Law. The discrepancies between these positions have been used by the defenders of relativism to reaffirm the non-existence of objective criteria of justice. In this paper we will defend human rights as the meeting point of the most relevant theories of justice and the cornerstone of just law.
