The article proposes a scientific and critical approach to labour and racism in the exclusion of the black population from the labour market. It highlights the need for labour law and the justice system to consider that legal labour protection must prioritise human beings and their activities. The reflection also argues that the exercise of citizenship, understood as social belonging and access to the civil, political and social rights provided for in the Constitution, is directly linked to the right to personality, which has work as one of its fundamental elements, something that is still not fully guaranteed to the black population.
O artigo propõe uma abordagem científica e crítica sobre o trabalho e o racismo na exclusão da população negra do mercado de trabalho. Destaca a necessidade de o Direito do Trabalho e o sistema de justiça considerarem que a proteção jurídica trabalhista deve priorizar o ser humano e sua atividade. A reflexão também defende que o exercício da cidadania, entendido como pertencimento social e acesso aos direitos civis, políticos e sociais previstos na Constituição, está diretamente ligado ao direito de personalidade, que tem o trabalho como um dos elementos fundamentais, algo que ainda não é plenamente assegurado à população negra.
