La implementación de la oralidad con el dictado de la Ley 10555, modificatorias y protocolos dictados por el Tribunal Superior de Justiciade la Provincia de Córdoba, ha sido un gran acierto para la tramitación diaria de los juicios, la que desde antaño lentificaba el proceso, incluso siendo varios los años que había que esperar para el dictado de la sentencia. No obstante,esta nueva celeridad que llegó para quedarse, no debemos descuidar la eventual etapa por la que puede transitar el proceso, cual es la instancia recursiva, en especial el recurso de apelación de la sentencia ante las Cámara de Apelacionesde la Provincia Córdoba. Es aquí, donde a mi entender, el legislador no se ahondo demasiado y ello puede verse como un punto a mejorar en la normativa legales que rige este tipo de procesos en la faz impugnativa ante el tribunal de Alzada. Por ello es menester una reforma legislativapara pulir yaggiornarel recurso de apelación,tal como lo prevé el Código Procesal Civil y Comercial de la Provincia de Córdoba,a los nuevos vientosde oralidad que transitan el procesocivil cordobés.
The implementation of orality with the issuance of Law 10,555, amendments and protocols issued by the Superior Court of Justice of the Provinceof Córdoba, has been a great success for the daily processing of trials, which has slowed down the process since long ago. Even though there were several years to wait for the sentence to be handed down. Despite this new speed that is here to stay, we must not neglect the eventual stage through which the process may go, which is the recursive instance, especially the appeal of the sentence before the Court of Appeals. This is where, in my opinion, the legislator did not delve too deeply and this can be seen as a point to improve in the legal regulations that govern this type of process in the contestation phase before the Court of Appeal. For this reason, a legislative reform is necessary to polish and update the appeal, as provided for in the Civil and Commercial Procedural Code of the Province of Córdoba, to the new winds of orality that are passing through the civil process in Córdoba.
