Sin entrar en valoraciones de ninguna clase sobre el controvertido caso Alves, se pretende extraer alguna experiencia probática del mismo. Particularmente, se reflexiona sobre la existencia de herramientas probatorias adecuadas para esclarecer lo sucedido en ámbitos íntimos o, cuanto menos, alejados de miradas ajenas o del alcance de mecanismos de registro. Se explora la institución procesal penal de la reconstrucción de hechos tan eficaz como necesaria en este tipo de casos. Se sugiere cómo habría podido llevarse a cabo en este supuesto, a modo de propuesta a futuro.
Without entering into any kind of evaluation of the controversial Alves case, the aim is to extract some evidential experience from it. In particular, it reflects on the existence of adequate evidential tools to clarify what happened in intimate environments or, at least, away from the gaze of outsiders or the reach of recording mechanisms. The criminal procedural institution of the reconstruction of facts, as effective as it is necessary in this type of case, is explored. It is suggested how it could have been carried out in this case, as a proposal for the future.
