El reconocimiento normativo que se le da a la seguridad social a través de las cartas magnas de Latinoamérica contribuye a la justiciabilidad de ese derecho humano. Sin embargo, poco se ha estudiado el impacto que tiene ese reconocimiento constitucional para el desarrollo del Derecho Internacional de la Seguridad Social (DISS) regional que es la garantía legal del derecho humano a la seguridad social de los migrantes. En ese sentido, este artículo presenta un breve estudio del DISS regional y analiza el marco constitucional del derecho humano a la seguridad social en algunos ejemplos de América Latina, resaltando el importante papel de la Corte Interamericana de Derechos Humanos, con el objetivo de comprobar que la teoría emanada del neo constitucionalismo social proporciona nuevas perspectivas al Derecho Internacional de la Seguridad Social regional.
The normative recognition that is given to social security through the Latin American letters contributes to the justiciability of this human right. However, there are not a lot of studies about the impact of this constitutional recognition for the development of regional International Social Security Law (DISS), which is the legal guarantee of the human right to social security for migrants. In this sense, this article presents a brief study of the regional DISS and analyzes the constitutional framework of the human right to social security in some examples from Latin America, highlighting the important role of the Inter-American Court of Human Rights, with the aim of verifying that The theory emanating from the neo-constitutional socialism provides new perspectives to the International Law of regional Social Security.
