La fuerte exposición a la captura ad extra y ad intra de los Consejos de Justicia ha impuesto la necesidad de replantear los modelos nacionales de judicial governance para que vuelvan a adquirir la función de garantes de una Justicia independiente y por tanto de la estabilidad del Estado de Derecho. Por ello, el presente trabajo, tras profundizar en la experiencia de Italia, España y Polonia, tres Estados Miembros de la UE, que presentan aspectos de interés y están siendo caracterizados por importantes procesos de reforma, se centrará en los estándares elaborados por el TJUE y, en particular, por el TEDH, los cuales pueden constituir la base para el desarrollo de un modelo de justicia común.
The strong exposure to ad extra and ad intra captures of the Councils of Justice has imposed the need to rethink the national models of judicial governance. Only in this way, these bodies could once again guarantee an independent Justice and the stability of the Rule of Law. Therefore, this paper, after the study of Italian, Spanish and Polish experiences, three EU Member States, with aspects of interest, characterised by important processes of reform, will focus on the standards of the CJEU and, specially, the ECtHR. Such standards can constitute the basis for the development of a common justice model.
