En este trabajo se realiza un estudio detenido y crítico sobre los tratados internacionales de reciprocidad, como única vía señalada por la Ley Orgánica de Régimen Electoral General para atribuir el derecho de sufragio en las elecciones municipales a los extranjeros no Comunitarios residentes en España. A este fin, se expone, a grandes rasgos, el estado del Derecho Comparado, como punto de referencia para la apreciación de la reciprocidad,se analiza el conjunto de tratados suscritos, tanto en sus aspectos formales, como en los materiales, se da cuenta de los tratados que no se han podido suscribir y por qué, se realiza una caracterización general de su proceso de concertación, y, finalmente, se hace balance sobre esta vía normativa, que se advierte limitada en su esencia y prácticamente ya agotada en sus posibilidades de desarrollo, y se reflexiona sobre los posibles cambios a introducir en el ordenamiento con vistas a conseguir una mayor extensión del derecho de sufragio de este colectivo.
In this work, a detailed and critical study is carried out on international reciprocity treaties, as the only way indicated by the Organic Law of the General Electoral Regime to attribute the right to vote in municipal elections to non-EU foreigners residing in Spain. To this end, the state of Comparative Law is presented, broadly speaking, as a point of reference for the appreciation of reciprocity, the set of treaties signed is analyzed, both in its formal and material aspects, and it is realized. of the treaties that have not been signed and why, a general characterization of their conclusion process is carried out, and, finally, an assessment is made of this regulatory path, which appears to be limited in its essence and practically already exhausted in its possibilities. of development and reflects on the possible changes to be introduced in the regulations with a view to achieving a greater extension of the right to vote for this group.
