    El trabajo analiza los problemas prácticos del nuevo supuesto de excepción a los principios deinmediación y contradicción en casos de retractación de la víctima, introducido por la Ley N°21.523 en el literal f) del art. 331 del Código Procesal Penal. Para estos efectos, la investigaciónofrece el marco teórico que dota de contenido a los principios anotados como garantías integrantesdel derecho a un juicio oral, justificando una interpretación restrictiva de sus excepciones, conlas precisiones que supone un adecuado concepto de retractación. A continuación se sistematizalas problemáticas asociadas a dos órdenes de ideas: en primer lugar, el ámbito de aplicaciónobjetivo de la excepción (delitos) y la concreta modalidad que debe asumir su verificación(reproducción o lectura de declaraciones anteriores); y, en segundo lugar, las dificultades quepresenta la exigencia legal según la cual la solicitud debe ser sustentada en informes psicológicosy los antecedentes relativos a la evaluación del riesgo en que se encuentra la víctima; todo con elobjetivo de proporcionar opciones interpretativas que calibren la protección y fortalecimiento delos derechos de las víctimas y el respeto por el estatuto de garantías que ampara al imputado.

    This work analyzes the practical problems of the new exception case to the principles of mediationand contradiction in cases of retraction of the victim, created by statute No. 21,523 in letterf) of article 331 of the Criminal Procedure Code. For these purposes, this research offers thetheoretical framework that gives content to such principles as integral guarantees of the rightto an oral trial, justifying a restrictive interpretation of its exceptions, with the clarificationsthat represent an adequate concept of retraction. Afterwards, the problems associated with twoset of ideas are systematized: first, the objective scope of application of the exception (crimes)and the specific modality that must be assumed in its verification (reproduction or reading ofprevious statements); and, secondly, the difficulties presented by the legal requirement accordingto which the request must be supported by psychological reports and by the background informationregarding to the evaluation of the risk that the victim is in; all with the aim of providinginterpretative options that balance the protection and strengthening of the rights of victims andrespect for the statute of guarantees that the accused holds.
