El tránsito hacia un modelo de justicia administrativa centrada en la tutela de derechos e intereses,no ha traído aparejado el reconocimiento a los jueces de poderes plenos y amplios para brindar latutela requerida por los administrados. Así, la subjetivización del contencioso administrativoexperimentado en diversos ámbitos, contrasta con un modelo de control judicial que reposa sobreun esquema anulatorio de actos ilegales, y que no reconoce al juez poderes de mayor intensidad,salvo contadas excepciones. La consecuencia de este déficit normativo es la limitada protecciónque pueden recabar los ciudadanos de la justicia administrativa, lo que no resulta consistentecon las exigencias del derecho fundamental a la tutela judicial efectiva.
The transition towards a model of administrative justice focused on the tutelage of the rightsand legitimate interests, has not yet to bring with it led recognition of full and broad powers forjudges to provide the protection required by citizens. Thus, the subjectivization of administrativelitigation experienced in various areas contrasts with a model of judicial control that restson an annulment system of unlawful administrative acts, which also does not recognize to thejudge powers of greater intensity, except in a few exceptions. This regulatory deficit limits theprotection that citizens can obtain from the administrative justice, which is inconsistent withthe standards demanded by the fundamental right to effective judicial protection.
