Este trabajo analiza de modo crítico la actual política migratoria en España. Para ello, se presta especial atención al dilema transversal de la compatibilidad entre la normativa de extranjería y la de protección internacional. A continuación, se aborda las dos grandes cuestiones que resultan problemáticas con anterioridad a la entrada en territorio español y después de la misma, que tienen que ver especialmente con la gestión de las fronteras y la integración. En concreto, son primordiales en este punto las obligaciones que se establecen en los nuevos instrumentos a nivel europeo para asegurar la entrada legal, junto con los mecanismos que se habilitan a nivel nacional para potenciar la integración. Por último, se examinan las cuestiones básicas del nuevo reglamento de extranjería que ya se alinea con las directrices europeas. Desde este análisis de aspectos de gran complejidad se realizan propuestas para afrontar los retos pendientes inaplazables si se quiere articular una política migratoria que respete y garantice los derechos humanos.
This paper carries out a critical analysis of the current immigration policy in Spain. To this end, special attention is paid to the transversal issue of compatibility between immigration legislation and international protection regulations. Next, the two major issues that pose problems before and after entry into Spanish territory are addressed, which are especially concerned with border management and integration. Specifically, the obligations established in the new instruments to ensure legal entry at European level, along with the mechanisms enabled at national level to promote integration are essential at this point. Finally, the basic concerns of the new immigration regulation that are already aligned with European guidelines will be examined. Based on this analysis of highly complex aspects, proposals are made to address the pending challenges that cannot be postponed if we want to articulate an immigration policy that respects and guarantees human rights.
