In recent times we are witnessing the emergence of new realities within the trans* collective, giving visibility to situations or circumstances that until a few years ago were completely invisible and absolutely silenced. This is the case, without going further, of the question of trans-sexuality in child-hood and adolescence. It seems that we are living the initial moments of what is called to be a paradigm shift: the failure to understand the experience of trans* children and adolescents as a pathology, as an identity disorder or problem, and to consider it as a set of constructions and choices of a very personal character, with heterogeneous, fluid and changing trajectories, to which law should not turn away. It is for this reason that in this article we analyze the social and legal context that surrounds the lives of children and adolescents trans* in Chile, with particular emphasis on those aspects that characterize the right to (gender) identity in those cases where their ownership is a minor.
Nos últimos tempos, assiste-se ao aparecimento de novas realidades no interior do coletivo trans*, a dar visibilidade a situações ou circunstâncias que, até há poucos anos, eram completamente invisíveis e absolutamente silenciadas. Esse é o caso, sem ir muito além, da questão da transexualidade na infância e na adolescência. Parece que vive-se os momentos iniciais daquilo que se está chamando de uma mudança de paradigma: o deixar de entender a experiência das crianças e adolescentes trans* como uma desordem identitária ou um problema e passar a considerá-la como um conjunto de construções e eleições de caráter personalíssimo, de trajetórias heterogêneas, fluidas e mutáveis, às quais a lei não deve nem pode dar as costas. É por isso que, no presente artigo, se analisará o contexto social e legal que rodeia a vida das crianças e dos adolescentes trans* no Chile atual, incidindo particularmente naqueles aspectos que caracterizam o direito à identidade (de gênero) naqueles casos em que sua titularidade recai sobre uma pessoa menor de idade.
