The article has as its starting point the drastic modification of the global structure in the post-Second World War period, with a bias in the light of the theory of liberties and the right to development, which reveals the guiding premise of the text, that economic development is only social development and respect for human rights. Thus, the focus is on its main purpose, namely the study of social, economic and cultural rights and civil and political rights from the perspective of International Human Rights Law, analyzing the provisions of the International Covenant on Economic, Social and Cultural Rights and Cultural. Therefore, the research that has a qualitative character will be used for literature review and analysis of legislation on the object studied, drawing a parallel between the provisions of the Pact and the right to development.
O artigo tem como ponto de partida a drástica modificação de estrutura global no período do pós Segunda Guerra, com viés à luz da teoria das liberdades e do direito ao desenvolvimento, da qual se depreende a premissa norteadora do texto, de que desenvolvimento econômico só se alcança com desenvolvimento social e respeito aos direitos humanos. Assim, a abordagem se volta a seu objeto principal, qual seja o estudo aos direitos sociais, econômicos e culturais e aos direitos civis e políticos, sob a perspectiva do Direito Internacional dos Direitos Humanos, analisando o disposto no Pacto Internacional dos Direitos Econômicos, Sociais e Culturais. Para tanto, a pesquisa que tem caráter qualitativo se utilizará de revisão de literatura e análise de legislação sobre o objeto estudado, trançando um paralelo entre o disposto no Pacto e o direito ao desenvolvimento.
